Publisher of the Site

The website kadaassociates.com (hereinafter "the Site") and the artificial intelligence "Alim" that it offers are published by Kada & Associates, whose registered office is located in Paris, France.

For any question relating to the publisher of the Site, its content or its operation, please contact: contact@kadaassociates.com.

The publication director is the legal representative of Kada & Associates.

Intellectual Property

All elements of the Site (text, structure, sitemap, visual identity, logo, the "Alim" visual identity, source code, databases and software that make it up) are, unless expressly stated otherwise, the exclusive property of the publisher or its partners, and are protected as such under the French Intellectual Property Code, in particular under copyright law (Articles L.111-1 et seq.), trademark law, and database rights (Articles L.341-1 et seq.).

Any reproduction, representation, distribution, modification, translation, adaptation, extraction or exploitation, in whole or in part, of these elements, by any means and on any medium whatsoever, without the prior written authorisation of the publisher, is strictly prohibited. Any infringement may constitute an act of counterfeiting engaging the civil and criminal liability of its author, within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code.

The name "Kada & Associates", the names of the firm's practice areas (Atlas Advisory, Kada Legal Operations, Kada Dispute Resolution), as well as the "Alim" mark and its associated technology ("Alim Persona Technology"), constitute distinctive signs of the publisher, whether or not formally registered. Any unauthorised use of these elements, in particular for commercial purposes or in a manner likely to create confusion in the mind of the public, engages the liability of its author.

AI-Generated Content and Historical Personas

The conversational exchanges generated by "Alim" and by the historical personas offered on the Site (in particular Machiavelli, Seneca, Mazarin and the other figures presented, as well as any advisor created through the customisation feature) are produced by an artificial intelligence system. These personas draw on works and sources that have fallen into the public domain; the syntheses, reformulations, conversational staging, dialogue structures and editorial treatment applied to them on the Site constitute original editorial work and remain the exclusive property of the publisher, protected under the same conditions as the rest of the Site.

By their nature, responses generated by artificial intelligence, including when a persona adopts the personality and style of a historical figure, are produced automatically from language models. They:

  • do not reflect an opinion, a position, or formal advice from the publisher or from any legal professional registered with a bar or professional body;
  • may contain approximations, errors, anachronisms or omissions, including in the attribution of statements or ideas to a historical figure;
  • do not, under any circumstances, constitute legal, tax, accounting or strategic advice tailored to an individual situation, nor an act of legal consultation within the meaning of French law n° 71-1130 of 31 December 1971;
  • may not engage the publisher's liability in the same manner as an individual consultation provided by a qualified professional under a dedicated contractual relationship.

The user acknowledges using these features for informational, educational and orientation purposes only, at their own responsibility. For any matter requiring personalised and legally binding analysis, it is strongly recommended to contact the firm directly through the channels provided for that purpose, rather than relying on exchanges with a persona on the Site.

In accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and French law n° 78-17 of 6 January 1978, as amended (the "Data Protection Act"), any data subject has the right to access, rectify, erase, restrict, object to, and port the data concerning them, as well as the right to issue directives regarding the fate of their data after death. These rights may be exercised under the conditions set out in the Privacy Policy, and, failing a satisfactory response, before the French data protection authority (CNIL).

Cookies and Trackers

The Site uses cookies strictly necessary for its operation, in particular to remember the language preference (French/English) and to maintain the login session, as well as, where applicable, audience measurement cookies. The placing and reading of these cookies are governed by Article 82 of the French Data Protection Act. For further details on their nature, purpose and the management of preferences, please refer to the Privacy Policy.

In accordance with Article 6 of French law n° 2004-575 of 21 June 2004 on confidence in the digital economy, any person who considers that content present on the Site is unlawful or infringes their rights may report it to contact@kadaassociates.com, specifying the elements identifying the content concerned and the grounds for the request. The publisher undertakes to handle this report as promptly as possible.

Hyperlinks

The Site may contain hyperlinks to third-party sites, in particular to the ConcordIA platform or to login and professional messaging services. The publisher exercises no control over the content of these third-party sites and disclaims all liability regarding their availability, content, security, or the personal-data practices applied there. The creation of a hyperlink to the Site from a third-party site requires the prior written consent of the publisher.

Limitation of Liability

The publisher endeavours, to the best of its ability, to ensure the accuracy and currency of the information disseminated on the Site, without guaranteeing the completeness, accuracy or currency of that information. Accordingly, the publisher disclaims all liability:

  • for any inaccuracy, error or omission relating to information available on the Site, whether of human origin or generated by an artificial intelligence system;
  • for any direct or indirect, material or immaterial damage resulting from access to the Site, its use, or the impossibility of accessing it, whatever the causes, origins, nature or consequences;

  • for any interruption, suspension or temporary malfunction of the Site, in particular for maintenance purposes;
  • more generally, for any damage resulting from the use or interpretation of content generated by the "Alim" artificial intelligence and its personas, under the conditions set out in the corresponding section above.

Force Majeure

The publisher may not be held liable for any delay or failure to perform resulting from the occurrence of a force majeure event as customarily recognised by French case law.

Partial Invalidity

Should any provision of this Legal Notice be declared void or unenforceable pursuant to a law, a regulation, or a final court decision, it shall be deemed unwritten, without affecting the validity of the remaining provisions, which shall continue to produce their effects.

Governing Law and Jurisdiction

This Legal Notice is governed by French law, without prejudice to any applicable conflict-of-law rules. Failing an amicable resolution, and subject to the mandatory rules applicable to consumers, who retain the right to bring proceedings before the court of their place of residence, any dispute relating to its validity, interpretation or performance shall fall within the exclusive jurisdiction of the courts of Paris.

Amendments to this Legal Notice

The publisher reserves the right to amend this Legal Notice at any time, in particular to comply with any legislative, regulatory, case-law, editorial or technical developments. The applicable version is the one published on the Site at the time of consultation by the user.
